I- REGULATORY MEASURES.
I-1. Transmission to the National Assembly, for review and vote, of the bill amending and supplementing law no. 2022-16 of 19 October 2022 bearing creation, organization and functioning of the Special Court of Land Affairs.
I-2. Creation of the Building Maintenance Company (SEMI) and approval of its statutes.
II- Communications.
II-1. Carrying out complete project management missions as part of agricultural technical high school rehabilitation projects, of professional technical high schools and construction of the Technical Tourism High School, Hospitality and Catering of Akassato as well as the Lycée de Jeunes Filles of Abomey.
II-2. Rehabilitation of buildings and acquisition of equipment for the benefit of the interventional cardiology and cardiovascular rehabilitation units of the Hubert Koutoukou MAGA National Hospital and University Center in Cotonou.

The following decisions were made :

I- REGULATORY MEASURES.
I-1. Transmission to the National Assembly, for review and vote, of the bill amending and supplementing law no. 2022-16 of 19 October 2022 bearing creation, organization and functioning of the Special Court of Land Affairs.
This supplementary bill suggests the redefinition of the powers of the Special Land Affairs Court, to enable it to now hear both actions claiming or confirming property rights as well as actions relating to expropriation for reasons of public utility.

Thereby, litigation over administrative acts in land and property matters remains within the jurisdiction of the administrative court.

The text also addresses, the redefinition of the territorial powers of the Special Court of Land Affairs. These extend over the communes of Abomey-Calavi, Allada, Cotonou, Ouidah, Porto-Novo, Sèmè-Podji and Tori-Bossito. Likewise, the Court now hears disputes relating to land extending over a municipality bordering those mentioned above, the law of 2022 not having specified the competent jurisdiction in this case.

In addition, the bill includes an organizational reform of the pretrial system which aims to modernize, improve and accelerate the process of managing legal cases for better efficiency of the public service, greater transparency and fluidity of relations with users.

So, the organization of a preparatory conference will make it possible to streamline the procedure with more predictability in order to reduce delays in the judicial investigation. This assumes that the parties agree in advance on the steps, the deadlines and procedural rules for the settlement of their case. The objective is to plan the process ensuring that all parties assume their responsibilities.

Finally, digital integration will promote the use of technologies such as electronic file management, remote hearings, electronic communication and case management tools, all things aimed at simplifying and automating legal processes.

The aim is to ensure the efficiency of judicial services, reducing costs and promoting free and permanent access for parties to information and documents in real time.

In total, this innovation will induce :

better monitoring by the parties to the trial, of their causes and the current settlement ;
more transparency on the progress of the procedure ;
strengthening confidence in the judicial settlement of cases, the parties understanding and actively participating in the process.
The Minister of Justice and Legislation will ensure the completion of the legislative procedure concerning this reform.

I-2. Creation of the Building Maintenance Company (SEMI) and approval of its statutes.
Since 2016, the execution of the Government Action Program has enabled our country to acquire a significant and quality real estate heritage, covering many sectors (residential buildings, administrative, hotel equipment, Recreation, etc.).

This remarkable development of real estate requires adequate and optimal maintenance, by professionals in the field, in order to guarantee the sustainability of the infrastructure built.

For this purpose, the State has joined forces with public or parapublic organizations, to create the SEMI whose services will cover the entire national territory.

In doing so, an appropriate framework will be established to ensure a supply of technical services and maintenance of built heritage, with the aim of creating an ecosystem and a value chain integrating SMEs-SMIs around these specific professions in a make-do approach.

Are concerned, waterproofing work, road maintenance, maintenance of electrical installations, plumbing, air conditioning, maintenance of green spaces, cleaning services, security and guarding, or the maintenance of technical systems and installations linked to physical infrastructures (video surveillance, elevators, etc.).

By adopting the statutes of the Company, the Council instructed the competent ministers to carry out the necessary procedures for the effective start of its activities.

Under other normative measures, the implementing texts of law no. 2013-01 of 14 August 2013 bearing the land and state code in the Republic of Benin, as amended and supplemented by Law No. 2017-15 of 10 August 2017 as well as the decrees relating to :

terms of application of law no. 2022-28 of 07 December 2022 governing the care and protection of victims on assigned missions or their dependents ;
creation, attributions, organization and functioning of the institutional coordination framework, monitoring and evaluation of the implementation of the National Financial Inclusion Strategy (SNIF) in the Republic of Benin ;
creation of the Calavi International Hospital Center and approval of its statutes ;
modification of decree no. 2023-409 of 26 July 2023 carrying attributions, organization and functioning of the Health Sector Regulatory Authority (ARS) ;
modification of decree no. 2021-520 of 13 October 2021 carrying attributions, organization and functioning of the General Secretariat of the Presidency of the Republic.

II- Communications.
II-1. Carrying out complete project management missions as part of agricultural technical high school rehabilitation projects, of professional technical high schools and construction of the Technical Tourism High School, Hospitality and Catering of Akassato as well as the Lycée de Jeunes Filles of Abomey.
After the award of the first wave of projects to firms for partial project management of 21 new agricultural technical high schools, of 6 trade schools, of 6 scientific high schools and 2 higher normal schools, this batch of establishments makes it possible to take into account the rest of the identified sites.

These are those of 9 former agricultural technical high schools, 15 former professional technical high schools and those intended for the construction of the Technical High School of Tourism, Hospitality and Catering of Akassato as well as the Lycée de Jeunes Filles of Abomey.

The selected firms will be responsible for carrying out all the services of the complete project management, in particular the state of the premises, investigations into existing infrastructures at the level of former high schools, the development, architectural programming and production of the standard sketch of each high school and school, carrying out preliminary preliminary design and detailed preliminary design studies.

These firms are also expected to provide other types of services leading to the development of the business consultation file.. They will then have to assist the contracting authority, particularly in procurement, supervision and control of works.

The ministers concerned will ensure that the necessary steps are taken to lead to the effective start of the construction sites..

II-2. Rehabilitation of buildings and acquisition of equipment for the benefit of the interventional cardiology and cardiovascular rehabilitation units of the Hubert Koutoukou MAGA National Hospital and University Center in Cotonou.
The rehabilitation work concerns premises where modern equipment will be installed to be acquired as part of the establishment of the center of excellence for interventional cardiology and cardiovascular rehabilitation in this hospital for better patient care..

These include interventional cardiology equipment, cardiovascular rehabilitation, furniture for the units that accommodate these specialties, of computer equipment and the installation of the computer network in said units.
